Staff Report of Recommendations for Changes to the Electoral Count Act of 1887

Here is the full report of recommendations by House Staff Members that Congress may be considering to make changes to the Electoral Count Act of 1887. The report is prepared by the Staff of the Committee on House Administration for Chair Zoe Lofgren, D-CA.

It is the STATES and not the Congress that chooses the President

Our first read-through and study of the report is that it contains good clarifying recommendations. Importantly, it states that the Founders very clearly did not intend for Congress to choose the President and that it remains the STATES job to do that. The recommendations clarify what it is that Congress, having been called upon by the Founders to receive, count and certify the States' Votes, shall do to make for a more stable result after the States are finished with casting their Electoral Votes.

By and large, we support this report and will probably be encouraging Congress to adopt most of it. We continue to study and get feedback. What is YOUR opinion about this report to Congress?

The NPVIC Language

The language of the NPVIC scheme is identical in all meaningful ways. Some variations appear to allow for differences in office titles, State-specific phrases, etc.

The State of Washington was the 5th State to join the plan, joining on its forst request in April 2009.

Excerpt: "In an era when disputed elections are becoming more common and where the laws governing presidential elections are already riddled with dangerous ambiguities, the NPVIC is an invitation to a constitutional crisis. With the world’s most powerful office at stake, America’s presidential election procedures need certainty and stability. The National Popular Vote Interstate Compact threatens to bring us the exact opposite, an election in which the rules would be extremely uncertain and unsettled."

The Bill -

This NPVIC scheme has a self-defined activation threshold of 270 Electoral Votes, meaning that when they sign on enough States that have 270 Votes, they have agreed to begin seating their presidential Electors according to the will of a "national" popular vote tally, IGNORING the vote tallies of their own IN-State voters.

Text of the National Popular Vote Interstate Compact. This identical legislation is what has been entered into 48 State Legislatures since 2006 and PASSED by 15 legislatures, plus DC.
